Meeting with CPMG on Transfer case of Shri I.N.Naikwadi.


On 24.07.2013 myself met with Hon’ble Chief Postmaster General Maharashtra Circle to discuss the issue related to abrupt transfer of Shri I. N. Naikwadi, ASP, Ichalkaranji Sub Divison ( Kolhapur Division-Goa). I was accompanied by Shri Vilas Ingale General Secretary, Shri M. S. Ahirrao Circle President and Shri M. B. Dapse Circle Vice President.

From Administration side Col. K.C. Mishra VSM Chief Postmaster General Maharashtra Circle, Shri S.B.Vyavahare APMG (PSR) and Shri S. B. Hoshing ADPS (Technology) were present.

Hon’ble CPMG apprised about his visit of Narsobawadi (T/S) Post Office and the circumstances compelled him to take such action was also explained in detailed. Shri S. B. Hoshing ADPS (Technology) who was accompanied to CPMG during his visit also described irregularities noticed with facts and figures during their visit. The details of irregularities noticed by them and put forth before us are as under:
1) Signature scanning work of three accounts was not done.
2) Delivery status of RLs were not updated
3) Four undelivered accountable articles kept in the deposit were found without remarks from delivery staff & these articles are not kept at one place duly tied.
4) Sufficient stock (As per Consolidated Memo of authorised Balances) of Postage Stamps, Revenue stamps and stationary items were not supplied to Branch Offices.
5) Mis-management of Old Record.
6) Non achievement of proportionate target by PO, as per the allotment.
7) Stock book of pass books not provide for inspection and few PBs were found scattered at various places.

Official side members took active part in the discussion on each point and it was told that the SPM is actually responsible for maintenance of above items and it was learnt that he  has given notice of  voluntarily retirement from Govt. service, hence SPM might have doing the work lethargically. Hon’ble CPMG immediately replied that he has already asked to divisional head to transfer the said SPM immediately. The duties and responsibilities of sub divisional head were also discussed in length. The importance of holding the periodical meetings with sub divisional heads and divisional heads were described by Hon’ble CPMG in length. Association explained the work, conduct and achievements made by Shri I. N. Naikwadi in field work with facts and figures. CPMG has appreciated the field work of Shri Naikwadi.  The members also explained how IPs/ASPs are important in the organisation and their contribution in achievements of the target at Circle level, CPMG fully agreed to that and further told all the IPs/ASPs in the Circle are doing good work and they are backbone of the India Post. Each and every point was discussed in depth and up to the satisfaction of the Hon’ble CPMG and finally we requested CPMG Sir to consider the case of I. N. Naikwadi and restore the transfer order, actually we were expecting immediate restoration of transfer order but CPMG Sir has assured to consider his transfer sympathetically at appropriate time. The meeting concluded at 14.30 hrs. 

Indian Postal Dept Makes room for IT Letter Boxes


INDIA: The letter that travels to our door may have new technology stamped all over. As the backbone of India's communication for over 150 years, the DoP plays a crucial role in the socioeconomic development of the nation. Urbanization, increased demand for financial services and increased funding by the government for the weaker sections and the rural sector have opened up new opportunities for the DoP and necessitated the development of new processes as well as supporting technology.

SAP AG announced that the Department of Posts (DoP), the government-operated postal system of India, has chosen SAP solutions to strengthen responsiveness and reliability across more than 155,000 post offices.

With this implementation, the DoP aims to deliver faster and more efficient services to the citizens and government and private organizations of India. The DoP is now one of more than 30 postal customers globally that have chosen SAP solutions to make mission-critical and customer-facing processes more effective, as shared in the announcement.

"SAP postal services customers are leveraging the latest technology to transform their business, from improving efficiency in back-office and core processes to creating new lines of operations within their existing infrastructure," said Hans G. Landgraf, head of Business Segment Postal, SAP AG. "With our experience, SAP is eager to help India's Department of Posts improve its business and increase transparency across its organization in order to meet the changing demands of its customers."

Armed with a transformation charter that includes a complete overhaul of operations under an IT modernization project, the DoP will leverage SAP applications that include SAP ERP, SAP Customer Relationship Management (SAP CRM) and SAP Supply Chain Management (SAP SCM) to help increase process efficiencies and meet its business, social and financial inclusion goals. As the DoP generates revenue of more than EUR1.1 billion while employing nearly 474,000 employees, it will also implement SAP solutions for streamlining internal processes in the areas of human resources, payroll processing and finance and accounts.

In addition to running core and back-office operations, SAP Sybase Adaptive Server Enterprise, SAP Sybase IQ software, SAP BusinessObjectsTM solutions and SAP Data Services software will offer the DoP the data warehousing and business intelligence (BI) needed for its entire operations system.

The Government of India also intends to utilize the DoP's vast network for its direct cash transfer function, which aims to reduce leakages, cut down corruption, eliminate middlemen, target beneficiaries better and speed up transfer of benefits to eligible individuals. Workers across India, especially those in rural areas, will be able to reap the gains from the direct benefits transfer (DBT) leveraging their existing savings accounts in post offices.


Today, the DoP delivers more than six billion articles every year through its elaborate network of offices. The reengineering of business process using SAP solutions will enable the DoP to increase its engagement with the Indian population through more customer interaction channels. SAP software purportedly will help the organization improve automation of core processes including postal counter automation, track and trace, logistics post, e-commerce and customer interaction channel.

An Abrupt Transfer Of ASP : We Condemn the action of Administration.


Shri I.N.Naikwadi  ASP Ichalkaranji ( Goa Region ) has been abruptly transferred to Nagpur region. The officer is senior most ASP and left only one and half years of service. He is our Asstt Circle Secretary of Goa Region.

CPMG was on visit to Narsobawadi Post Office under Kolhapur Division, during visit  of Post office some old record found in the cupboard , suddenly CPMG asked who is ASP and on next moment he asked over phone to APMG Staff to  issue transfer order of shri Naikwadi to Nagpur and that too he was asked to make charge report on the spot. It is  a humiliation not only to that ASP but to All IP/ASP Cadre.

The action of the administration is condemned from all walks of life. The officer is most sincere and hard working. last year he has opened 38146 new accounts ,1800 RPLI policies, he assisted his division in 100% past work verification in fraud case of another subdivision.This year he was given target of 20000 new accounts and up to June he has opened 10496 accounts.

Since CPMG is on tour we couldnot meet him , as soon as he reached head quarter he will be apprised about the resentment among the members and requested to cancel the transfer immediately. Hope Administration will restore the transfer order.

Uncommunicated adverse remarks in the confidential report of a Government servant will not stand in his way of promotion, in this case to the grade of HSG- II and further promotion to HSG Grade  I Further , minor penalty awarded to an official will not stand in his way of promotion.  

Facts : The Applicants appointed as Postal Assistant in 1965 was transferred to Allahabad Division and Joined there on 23.08.1967.He was promoted to LSG Grade w.e.f. 30.11.1983 after completion of 16 years of service as Postal Assistant in the pay scale of Rs 4500-7000. Second financial upgradation was granted to him under BCR Scheme in the scale of pay of Rs 5000 – 8000 w.e.f. 1-7-1992.

As per norm–based promotion based on seniority cum suitability ,his case was left out for promotion to HSG II.. His name was also left out for promotion from HSG II to HSG I based on the norms. He superannuated on 30.9.2006.In view of his non-promotion to HSG II and I, he filed this OA for his promotion to that grade on the appropriate dates quashing the impugned order of 19-9-2006 of the Appellate Authority refusing to promote him as the minor penalties cannot stand in his way of promotion with all consequential benefits of fixation of pay on the appropriate dates and refix his pension based on that fixation.

The main contention of the applicant is that ,he was not communicated any adverse remark in his CRs as also the minor penalty awarded to him may not stand in the way of his promotion.

The respondents submit that he was not considered fit for norm-based promotion to HSG II based on records. Hence the decision of CPMG was final As regards non-communication of adverse remark in the CRs of the official, no remark is given by respondents.

The Applicant was given average report for the years 2000-2001 and he was graded good for the years 2002-2003 and 2003-2004. He was visited with a minor penalty of stoppage of increments for two months on 20-02.2002; Hence the respondents submit that he has no case for grant of norm based promotion.

Whether the average grading in his CRs which were not informed to him stands in his way of promotion is answered by Apex Court in the case of Dev Dutt v union of India ( 2008 (8)SCC 725 ) It was said that benchmark in the CRs whether it is poor ,fair ,average ,good or very good should be communicated.

Following the decision in Dasidars case, it was held that:

Held: “keeping in view the above rule, it has to be held that the respondents shall consider the case of the Applicant for grant of notional promotion to the grade of HSG II and I without talking into account those un communicated reports which carry below benchmarks grading and if otherwise found suitable, afford the promotion on notional basis without any benefit of actual pay fixation.”

In the result the Applicant is to be promoted if he is otherwise found fit to the grade of HSG II and I ignoring those uncommunicated ACRS which carry grading less than benchmark and without considering the minor penalty awarded to him in 2002. The promotion is on notional basis without any payment of arrears except for his pension fixation and terminal benefits. Six months is given for completion of this order.

Last Minute Rush As India Stops 163-year-Old Telegram Service .

Thousands of Indians crammed into telegram offices today to send souvenir messages to friends and family in a last-minute rush before the service shuts down after 162 years. Today is the last day that messages will be accepted by the service, the world's last major commercial telegram operation, and the Central Telegraph Office in New Delhi said it was geared up to tackle the expected rush.

१६३ वर्षांपूर्वी सुरू झालेली तारसेवा रविवार रात्री आठ वाजता काळाच्या पडद्याआड गेली. तारसेवेची शेवटची आठवण म्हणून अनेकांनी विशेषतः तरुणांनी अशी शेरोशायरीची उधळण करीत मित्रमंडळींना तार केली. शेवटची तार पाठवण्यासाठी चर्चगेटजवळच्या सीटीओ ऑफिसमध्ये रविवारी गर्दी उसळली होती. ही गर्दी कायम राहिली असती तर तार बंद झाली नसती ', अशा भावना व्यक्त करणाऱ्या तार खात्याच्या कर्मचाऱ्यांची मात्र वेगळीच 'हृदयाची तार छेडली गेली होती. 

मोबाइल आणि ई-मेलच्या जमान्यात तारसेवा मागे पडली तरीही तीची विश्वासार्हता तसूभरही कमी झालेली नव्हती. पण काळाच्या ओघात सरकारने तारसेवा बंद करण्याचा निर्णय घेतला. आज १५ जुलैपासून तारसेवा बंद झाली. ही सेवा रविवारी रात्री आठवाजेपर्यंतच सुरू राहणार असल्याने शेवटची तार करण्यासाठी सीटीओ म्हणजेच आताच्या बीएसएनएल च्या चर्चगेट येथील ऑफिसमध्ये रविवारी मुंबईकरांचा ओघ लागला होता. दिवसभरात १२ हजार तारा केल्या गेल्या. 

तरुण मंडळींमध्ये तार करण्यासाठी उत्साह संचारला होता. बोरीवलीच्या सौमित्र मजमूदार याने शरोशायरीची उधळण करीत तार केली. इजिप्तमध्ये महमद मोर्सी यांना अध्यक्षपदावरून पायउतार व्हावे लागल्याने वर्षभरातच त्यांचे साम्राज्य संपले. त्याचा धागा पकडत सौमित्रने , ' उधर मिस्र से हटा मोर्सी का राज... इधर हिंदुस्थान से हटा मोर्सी का कामकाज असा उल्लेख करीत तार केली. ब्रिटिशांच्या काळापासून कडकट्ट... कडकट्ट.. अशा सांकेतिक भाषेत मोर्सकोडवरून तार पाठवली जात होती. त्याचा संदर्भ सौमित्रने घेतला होता. 

तार पाठवण्यासाठी ब्रिटिश बनावटीची १८३४ मधील मोर्स मशिन आजही सीटीओ ऑफिसमध्ये आहे. मोर्स मशिनवर आलेला संदेश टिपून घेण्यासाठी जीव ओतून कडकट्ट कडकट्ट ऐकावे लागे. १९९०पर्यत मोर्स मशिनवरून तारा पाठवल्या जात होत्या अशी आठवण चीफ टेलीग्राफ मास्टर अनघा खांबेटे व हेमलता चव्हाण यांनी सांगितली.

Subject: Guidelines on Air Travel on Official Tours / Leave Travel Concession (LTC) – reg.

Reference is invited to instructions issued by the Department of Expenditure, Ministry of Finance from time-to-time regarding the procedure for booking of air tickets on Government account. As per existing procedure Government officials/offices can book the air tickets directly from Airlines (at Booking counters / Website of Airlines) and if needed, by utilizing the services of authorized agents. viz. M/s Balmer Lawrie & Company Limited (BLCL) and M/s Ashok Travels & Tours (ATT) [Department of Expenditure OM No.19024/1/2009-E.IV dated 16/09/2010 refers]. Air tickets for travel on LTC, to a limited extent, can also be get booked through Indian Railway Catering & Tourism Corporation(IRCTC) [Department of Personnel & Training 0M No. 31011/6/2002-Estt.(A) dated 02/12/2009 refers].

2. It has now been decided to include IRCTC as an authorized for the purpose of booking air tickets on Government account.Accordingly, if the services of a travel agent for booking air tickets on Government account is to be availed of, in addition to BLCL and ATT, the services of IRCTC can also be availed of.

3. All Ministries/Departments of the Government of India. etc. may accordingly bring these instructions to the notice of all concerned for strict compliance.

Cat Case for Up Gradation of Grade Pay of IP Cadre - An Update.


OA No. 289/13 filed by CHQ adjourned to 8/8/2013 before the Registers Court. The brief of reply filed by DOP is as under: 

None of the grounds raised by the applicant is tenable in the eyes of law or on facts. It is respectfully submitted at the risk of repetition that in compliance with the directions of this Hon’ble Tribunal contained in Annexure A-19 order, the issue was taken up with the Nodal Ministry, Department of Expenditure to have a re-look at the level of Secretary.  The matter was examined in the Nodal Ministry and it was not agreed for the up gradation of the Grade Pay of the Inspector (Posts) on par with that of the Inspectors of Income Tax CBDT and CBCE citing the following reasons:

(a) Inspector Posts were in the Pay Scale of Rs.5500-9000 prior to 6th CPC.  However, the 6th CPC in para 7.6.14 recommended, inter-alia,”……. The Commission is recommending the merger of pre-revised pay scale of Rs.5500-9000 and Rs.6500-10500 which will automatically bring Inspector Posts on par with Assistants in CSS/Inspector and analogous posts in CBDT/CBEC…..”.  Therefore, Inspector Posts have eventually come at par with Assistant CSS/Inspector CBDT/CBEC consequent on merger of pre-revised pay scalee of Rs. 5000-8000, 5500-9000 and 6500-10500.  As such, there was no specific recommendation in para 7.6.4 to the effect that Inspector Posts are granted pre-revised pay scale of Rs. 6500-10500.  Therefore, Inspector Posts have been granted normal replacement as per Part A of CCS(RP) Rules, 2008 and are rightly placed in the scale of Rs. 9300-34800 in  PB-2 with Grade Pay of Rs. 4200/-.  It is submitted that initially, as per recommendations of the 6th CPC in para 3.1.14, Inspector of CBDT/CBEC were also placed in the scale of Rs. 9300- 34800 in PB-2 with Grade Pay of RS. 4200/-. Subsequently, by virtue of being in the pre-revised pay scale of Rs. 6500-10500 as on 01-01-2006, they have been covered by Annexure A-8 OM dated 13-11-2009 and were placed in the pay of Rs. 9300-34800 with Grade Pay OF Rs. 4600/- corresponding scale of Rs. 7450-11500/-.

(b) Inspectors in CBEC/CBDT were placed in the scale of Rs. 6500-10500 with effect from 21-04-2004 ie, prior to 6th CPC by an executive order of the Government keeping in view their parity with Inspectors of CBI/IB and directions of the Hon’ble CAT, Jabalpur Bench.  Further, Assistants of CCS have also been granted the pay scale of Rs. 6500-10500 with effect from 15-09-2006 on the basis of their traditional parity with Inspectors CBEC/CBDT.  

(c)   Subsequently, Assistants of CCS were placed in the scale of Rs. 9300-34800 with Grade Pay of RS. 4600/- corresponding scale of Rs. 7450-11500/- vide Annexure A-10 OM dated 16-11-2009.  The Grade Pay of RS. 4600/-  has been extended to only four Head Quarter services ie, Central Secretariat Service (CSS), Armed Forces Headquarters Service  (AFHQ), Indian Foreign Service ‘B” IFS (B) & Railway Board Secretariat Service (RBSS) and their counterpart Stenographer Services. Therefore, it was a conscious decision of the Government to keep Assistants in CSS/Inspector and analogous posts in CBDT/CBEC in the higher pre-revised scale ie, Rs. 7450-11500/- considering their pre-revising relativities, hierarchical structure, mode of recruitment etc.  The mode of recruitment was not the only criteria as contended by the applicants in the OA.    In various cases, theApex Court also opined that wholesale identity between two groups would involve matters relating to nature of work, educational qualification, mode of appointment, experience etc.

(d)   It is pertinent to mention here that the Annexure A-8 & A-10 OMs came into existence as a result of demand from various quarters of Government seeking up gradation for pre-revised scale of RS. 6500-10500 due to functional requirement.   However, hierarchical structure of Inspector Posts does not demand such functional requirement, as post of ASP in the  scale of pay of Rs. 9300-34800 wityh Grade Pay of Rs. 4600 in PB-2 corresponding to pre-revised scale of Rs. 7450-11500 still exists, even after implementation of 6th CPC recommendations.

(e)   That the 6th CPC vide para 7.6.14 considered the demand for the scale of Rs. 6500-10500 at par with Inspector CBDT/CBEC and Assistants of CCS.  Since Inspector  Posts have come in the Pay Scale of Rs. 9300-34800 with Grade Pay of Rs. 4200/- in PB-2, corresponding to pre-revised scale of Rs. 6500-10500, the hierarchical posts in their cadre ie, ASP and SP had to be placed in the Grade Pay of Rs. 4600/- and Rs. 4800/- respectively to maintain the relativity in the cadre.  Moreover, the scale of other similarly placed posts ie, Assistant Manager and Manager in Mail Motor Service were also placed in the Grade Pay of Rs. 4600/- and Rs. 4800/- respectively.  In case the demand of Inspectors Posts for the Grade Pay of Rs. 4600/- is accepted, it will have cascading effect involving huge financial implications.   Also, the demand for up gradation from similarly placed posts in Mail Motor Service etc will arise immediately.

(f)  The duties and responsibilities of Inspector, CBDT/CBEC relates to enquiry and survey, assessment, tax evasion, petitions, prosecutions, TDS, tax recovery, prosecution  before Tribunals/Courts, investigations etc.  The Assistants of CSS performs the duties relating to parliament matters/cabinet matters, service matters, formulation/review/monitoring of national policy/programs on various subjects, assistance to executives, legislatures in the smooth functioning of the Government etc. Therefore, the duties and responsibilities assigned to the Assistants CSS and Inspector, CBDT/CBEC are quite different from that of Inspector (Posts).  There is no comparison between Assistants CSS& Inspector CBEC/CBDT and Inspector (Posts).  They are performing different duties in their respective cadres.

It is submitted that the issue was examined by the Secretary (Finance) and the  proposal  for up gradation of the Grade Pay of the Inspector (Posts) on par with that of the Inspectors of Income Tax CBDT and CBCE was rejected by the Nodal Ministry  citing the above mentioned reasons. The decision of the Ministry of Finance was communicated under the signature of the Under Secretary and the same was communicated to the applicants by the office of the 3rdrespondent. 

   Under the above circumstances, it is humbly prayed that the Applicants’ prayers in the Original Application are devoid of any merit and the Applicants are not entitled to get any of the reliefs sought for in the Original Application and the Original Application is liable to be dismissed with cost to the Respondents.
