As per outcome of National Council JCM meeting held on 26.06.2021  published by NC JCM the Cabinet Secretary stated that Department of Expenditure would process the matter for getting the Cabinet Approval for restoring the frozen DA / DR from 1/7/2021.

All Central Government employees and pensioners are anxiously waiting for the outcome of this meeting since the DA due to employees and DR due to the Pensioners are freezed from 1/1/2020 for 18 months. The Central Government employees and pensioners have contributed more than Rs. 40,000/ Crores by not receiving the DA/DR due for them. Now since the economy is getting revived according to the Government itself, Central Government employees and pensioners may be given DA and DR retrospectively with arrears. Hope Government will take a positive decision in this regard.

An agenda regarding withdrawal of order of DA/DR freeze was included for discussion in meeting. The decision of issue of order regarding restoration of enhanced DA/DR as per All India CPI(IW) Index not seen.  Cabinet Secretary stated that Department of Expenditure would process the matter for getting the Cabinet Approval for restoring the frozen DA / DR from 1/7/2021.

The Staff Side demanded that they are eligible for arrears from 1/1/2020 and the mode of payment can be discussed separately with the Staff Side. The Staff Side also demanded to extend the benefit to those employees who retired / expired between 1/1/2020 and 30/06/2021.

As per details of discussion stated above it is evident that the waiting for withdrawal of freezing of DA/DR doesn’t end and subject to approval of Cabinet.  It is also clear that process to get approval is also pending.

Subject: Holidays to be observed in Central Government Offices during the year 2022 - reg.

It has been decided that the holidays, as specified in Annexure-I to this O.M., will be observed in all the Administrative Offices of the Central Government located at Delhi/New Delhi during the year 2022. In addition, each employee will also be allowed to avail himself/herself of any two holidays to be chosen by him/her out of the list of Restricted Holidays specified at Annexure-II.

2. Central Government Administrative Offices located outside Delhi / New Delhi shall observe the following holidays compulsorily in addition to three holidays, to be chosen out of the 12 optional holidays indicated below at para 3.1:

3.1. For offices located in New Delhi/Delhi, three holidays are selected by the D/o Personnel & Training and for the offices located outside Delhi/New Delhi three holidays are to be chosen by the Central Government Employees Welfare Coordination Committee in the State Capitals, if necessary, in consultation with Coordination Committees at other places in the State, from the list indicated below. The final list, applicable uniformly to all Central Government offices within the concerned State, shall be notified accordingly and no change can be carried out thereafter. It is also clarified that no change is permissible in the festivals and dates, as indicated at Annexure -I and Annexure-II baring a few exceptions indicated at para 5.1 and 5.2 hereinafter. The 12 optional holidays are as follows:

3.2 No substitute holiday should be allowed if any of the festival holidays, initially declared, subsequently happens to fall on a weekly off or any other non-working day or in the event of more than one festival falling on the same day.

4. The list of Restricted Holidays appended as annexure-II to this O.M. is meant for Central Government Offices located in Delhi / New Delhi. The Coordination Committees at the State Capitals may draw up a separate list of Restricted Holidays keeping in view the occasions of local importance. However, the 9 occasions left over, after choosing the 3 variable holidays in para 3.1 above, are also to be included in the list of restricted holidays.

5.1 For offices in Delhi / New Delhi, any change in the date of holidays in respect of Idu’l Fitr, Idu’l Zuha, Muharram and Id-e-Milad, if necessary, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public Grievances and Pensions, after ascertaining the position from the Govt, of NCT of Delhi (DCP, Special Branch, Delhi Police).

5.2 For offices outside Delhi / New Delhi, the Central Government Employees Welfare Coordination Committees at the State Capitals are authorised to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in respect of Idu’lFitr, IdulZuha, Muharram and Id-e-Milad.

5.3 It may happen that the change of date in respect of the above occasions has to be declared at very short notice. In such a situation, announcement could be made through P.I.B/T.V./A.I.R./ Newspapers and the Heads of Department / Offices of the Central Government may take action according to such an announcement, without waiting for a formal order, about the change of date.

6. During 2022, Diwali (Deepavali) falls on Monday, October 24, 2022 (Kartika2). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on “Naraka Chaturdasi Day”. In view of this, there is no objection if holiday on account of Deepavali is observed on “Naraka Chaturdasi Day (in place of Deepavali Day) in the Central Government Offices in a State if in that State that day alone is declared as a compulsory holiday for Diwali for the offices of the State Government.

7. Central Government Organisations which include industrial, commercial and trading establishments would observe up to 16 holidays in a year including three national holidays viz. Republic Day, Independence Day and Mahatma Gandhi’s birthday, as compulsory holidays. The remaining holidays/occasions may be determined by such establishments/organisations themselves for the year 2022, subject to para 3.2 above.

8. Union Territory Administrations shall decide the list of holidays in terms of Instructions issued in this regard by the Ministry of Home Affairs.

9. In respect of Indian Missions abroad, the number of holidays may be notified in accordance with the instructions contained in this Department’s O.M. No.12/5/2002-JCA dated 17th December 2002. In other words, they will have the option to select 13 (Thirteen) holidays of their own only after including in the list, three National Holidays and Id-ul-Zuha, Mahatma Gandhi’s birthday, Milad -un- Nabi or Id-e-Milad and Christmas Day included in the list of compulsory holidays and falling on days of weekly off.

10. In respect of Banks, the holidays shall be regulated in terms of the extant instructions issued by the Department of Financial Services, Ministry of Finance.

Subject: Preventive measures to contain the spread of COVID-19: Attendance of Central Govt officials regarding.

With reference to Ministry of Personnel, Public Grievances and Pensions, (Deptt of DOPT) OM No. F.No. 11013/9/2014-Estt.A.II] dated 28th May 2021 and in continuation of this office circular No. even dated 12/05/2021 and in view of Covid-19 cases, it has been decided that as a measure to contain the spread of COVID-19, staff in respect of Main Office, Chandigarh and SAOs/AO/AAOs/staff in sub offices under PCDA (WC) shall attend the offices(s) to the extent of 50% on every alternate day from 01/06/2021 to 15/06/2021. Sr.AO/AO (as per Annexure ‘A’) and AAOs in Main Office, Chandigarh shall attend the offices to the extent of 50%.

2. The Officers In-charge shall prepare roster at their end accordingly. Those officials, who are not required to attend the office on a particular day, shall work from home and should be available on telephone and electronic means of communications at all times. Under no circumstances, such officials will leave the duty station. In case of any official work, the Officer-in-charge can call any official to attend office

3. The Officer in charge of any sub-office / section in Main Office can direct more officials to attend offices as per administrative requirement.

4. In Area Accounts Offices and PAO (ORs), Roster will be made by the Officers Incharge as per their requirement/monthly closing/pay bills etc.

5. It has been observed that some staff members avail leave between the days earmarked for work from home’ as per duty roster thus resulting in absenting themselves for continuous period, which not only affects the efficacy of the concerned Section/Group but also disrupts the duty roster system. It is enjoined upon all concerned that in case of officials availing such leave frequently, the entire period (work from home and leave availed on working days) shall be debited against the official’s leave of kind due to him.

6. All Group Officers/Officers-in-charge of Main Office and Sub Offices are directed to ensure that there is no pendency of work especially bills/letters in sections/offices for more than one week. It may also be ensured that for officials whose pendency in case of bills and letters is more than 07 working days, functioning of work from home would automatically stands cancelled.  Attendance of staff may be regulated accordingly.

7. It may be ensured that AAO of Section would attend the office when his SAO/AO works from home to avoid hampering of the work in Section. The Group Officer may assign SAO/AO under his/her administrative jurisdiction to Section/Group whose SAO/AO and Link Officer proceeds on leave/sick report or on work from home.

8. All Group Officers/ Officers-in-Charge may constantly review the status of their sections on daily basis and take necessary action besides ensuring correct and timely submission of control chart to AN-III section/System & Coord Section respectively. All the Officers and staff may be advised to get themselves vaccinated to effectively contain the spread of COVID-19. The guidelines/directions issued by government from time to time contain the spread of COVID-19 shall be strictly adhered to & strictly follow Covid appropriate behaviour during the said period.

Subject:- Procedure for offering/accepting post retirement contractual employments/assignment or consultancy ete.- reg.

It has been observed that sometimes, government organisations, in order to meet their functional requirement, use the expertise of retired government officials by hiring them on contractual basis, in the capacity of advisor/consultant etc. There is no defined procedure for seeking vigilance inputs before engaging retired government officials from the organisations where such retired officials were employed on full time basis, prior to their retirement.

2. Central Vigilance Commission has observed that the absence of a uniform detined procedure for obtaining vigilance clearance, before engaging retired officials by government organisations, sometimes lead to a situation where officials with tainted past or having cases pending against them are engaged by the government organisations. Such a situation not only leads to unnecessary complaints/allegations of favouritism, but is also against the tenets of fairness and probity which is the basic principle governing the functioning of government organisations.

3. The Commission has therefore decided to formulate a defined procedure before engaging a retired government official on contractual/consultancy basis by government organisations. The procedure to be adopted would include the following Steps:-

(1) In respect of retired officers belonging to All India Services, Group ‘A’ officers of Central Govt. or their equivalent in other organizations owned or controlled by Central Govt., before offering employment to them on contractual/consultancy basis, vigilance clearance from the employer organisation, from which the Govt. Officer had retired, should be necessarily obtained.

(ii) In case a retired officer had served in more than one organisation, vigilance clearance should be obtained from all organisations where the retired officer had served during a period of 10 years prior to his retirement.

(ii) A communication seeking vigilance clearance may also be sent to Central Vigilance Commission, simultaneously.

(iv) Incase, no reply is received from the erstwhile employer(s) within 15 days of sending communication by Speed Post to them, a reminder may be sent to them for expediting vigilance clearance. However, in case no reply is received from the erstwhile employer within 21 days of sending initial communication to them, it may be considered as ‘deemed vigilance clearance’ for the person concerned. Later on, if it is found that the ex-employee was involved in any vigilance related matter or was not clear from vigilance point of view, the erstwhile employer organization would be responsible for all consequential actions.

(v) The retired Govt. officer is to be considered for post retirement engagement only on receipt of vigilance clearance/vigilance inputs, subject to the conditions as given in sub para (i) to (iv) above

(vi) All communications regarding vigilance clearance should be sent by Registered Post/Speed Post, followed by emails on official mail ID of the organisation concerned.

(vii) The procedure for engaging retired government officers should be transparent with equal opportunity to all those, who are willing to offer their services. The post to be filled up on contractual/consultancy basis should at least be advertised on the website of the organisation concerned at appropriate place and should be available in public domain.

4. Further, it has been observed that on some occasions, immediately after their retirement from government organisations, retired officials are taking up full time job/contractual assignments in private sector organisations. Quite often, cooling off period, as prescribed under the rules of organisations concerned, is not observed before taking up such offers. Post retirement acceptance of offer by retired government officials without observing cooling off period, constitutes a serious misconduct on their part.

5. All government organisations may, therefore, formulate appropriate rules/guidelines for its employees to ensure that post retirement, cooling off period is mandatorily observed by them before accepting any offer from private sector entities. The rules/guidelines should incorporate procedure for seeking/obtaining permission before accepting offer from private sector entities during cooling off period if not in existence. The applicable service/conduct rules should also be revised/modified to ensure that, if required, appropriate action can also be initiated in case of violation of such rules by retired employees.

Maharashtra Circle today dedicated four ambulances for the welfare of the staff in a flag-off ceremony at Circle Office, Mumbai. These Ambulances are equipped with necessary medical aids, including oxygen cylinder, prepared by MMS Mumbai. These will be stationed at Kolhapur, Pune, Aurangabad and Nagpur for the use of Postal family.

Sub: One-time relaxation to the allottees of General Pool Residential Accommodation (GPRA) in view of second wave of Novel Coronavirus (COVID-19)- suspension of bidding for June, 2021 and re-validation of authority slip.

The undersigned is directed to refer to Directorate’s OM of even number dated 13.05.2021 and say that due to second wave of COVID-19 and hardships faced by Government employees in accepting allotted houses/ obtaining authority slips, it has been decided by the competent authority to grant one time relaxation in the following provision of CGGPRA Rules, 2017,

a) All the allottees of GPRA, who have done bidding for the month of April and May, 2021 , but could not obtain authority slip or take possession after obtaining authority slip due to spread of second wave of COVID-19. will be allotted accommodation after the period of suo-moto retention (i.e. upto 30.06.2021) is over. so that no problem is faced by them in taking authority slip or technical/physical occupation.

b) Bidding for the month of June, 2021 may be suspended as there will be hardly any vacancies available for bidding due to suo-moto retention i.e. upto 30.06.2021 issued vide OM of even number dated 13.05.2021.

c) In case applicant fail to accept any allotted houses, he/she shall not be debarred from bidding for three/six months whichever the case may be, as per rule 17( 1 ) and 1 7(3) of CGGPRA Rules, 2017.

d) Allottees who were issued authority slips but could not take possession within 5 working days of acceptance of allotted accommodation during the period of second wave of Covid-19, shall be re-validated for taking physical possession in relaxation of Rule 16(I) of CGGPRA Rules, 2017.

e) Licence fee shall be charged from the date of physical possession of CGPRA on the basis of re-validated authority slips in relaxation of Rule 73(1) of CGGPRA Rules. 2017.

2. NIC shall validate the already issued authority slips of all such allottees who could not take possession because of Corona situation after such requests are verified by the concerned Allotment Sections/AEMs in Regions.

3 . Allottees may be asked to obtain their revised Physical Occupation Report duly verified by concerned JE on the basis of supporting documents or physical verification , if necessary. The relaxation shall be given on case to case basis after examination by concerned Allotment Sections.
