Sub:   Presidential Award of Appreciation Certificates & Medals to be announced on the occasion of the Republic Day, 2021- reg.

Madam/Sir,

Every year, on  the  occasion   of   Republic   Day,  the   Presidential  Award   of Appreciation Certificates & Medals are granted to the officers of the Department for :-

  • Exceptionally Meritorious Service at the Risk of Life, and
  • Specially Distinguished Record of

(2) The proposals for the Presidential Awards on the occasion of the eve of Republic Day, 2021 , have now become due for consideration. Accordingly , the following action plan is proposed:-

  1. To have greater transparency in the selection process, the criteria has been summarised in Annexure-1 and the same may be widely circulated to enable the officers to apply for the Every formation shall forward all the applications received from officers under their jurisdiction as well as the proposals of deserving officers nominated by them, along with their recommendation/ comments, in the format prescribed in the form of Proforma – I & II and Annexures – A to L enclosed with this letter.
  2. The applications received by the Members of the Board in respect of the officers working under them as well as the  proposals  of  deserving  officers  nominated  by them, along with their recommendation/ comments, shall be forwarded, to DRI or DGGI, as applicable, latest by 21.2020.
  3. All the Customs Zones shall forward the Applications received from officers under their jurisdiction as well as the proposals of officers recommended by them to the Director General of Revenue Intelligence (DGRI) latest by 21.09.2020.
  4. All the Central Tax/ Central Excise formations shall forward the applications received from officers under their jurisdiction as well as the proposals of officers recommended by them to the Directorate General of GST Intelligence (DGGI) latest by 21.09.2020.
  5. The Directorates, namely, Directorate General of Audit (DG Audit) , Directorate General of Performance Management (DGPM), Directorate General of Systems (DG Systems) , Directorate General of Vigilance (DG Vigilance), Directorate of Logistics (DoL), Directorate of Data Management (DOM), Directorate of Legal Affairs (DLA), Directorate General of Taxpayer Services (DGTS), Directorate General of Human Resource Development (DG HRD), Chief Commissioner (AR), Settlement Commission, GST Council, Authority for Advance Rulings, and all the Sections of CBIC which are dealing with GST matters, shall forward their nominations to DGGI by 21.09.2020.
  6. The Directorates, namely, DG Export Promotion (DGEP), DG National Academy of Customs, Indirect Taxes and Narcotics (NACIN), DG Safeguards, DG Valuation, Directorate of CRCL, Central Economic Intelligence Bureau (CEIB), DG Analytics and Risk Management (DGARM), Narcotics Commissioner, Gwalior, Enforcement Directorate, all the Sections of CBIC (other than those dealing with GST) and the officers on deputation (with other Organisations/ Ministries/ Departments) shall send their nominations to DGRI by 21.09.2020.
  7. DGRI and DGGI shall compile and scrutinize the nominations/ proposals so received, along with the nominations/ proposals of officers under their own jurisdiction , prepare a short list of recommendations and forward all the applications/ proposals , along with such shortlist to this office positively by 23.10.2020. For this purpose, the Proforma -Ill shall be used and the same duly completed be forwarded to this office for ready reference (in “editable” format).
  8. Soft copy of the proposals, both in PDF form and Editable/ Word document, shall be forwarded to DGRI/ DGGI (as applicable), with a copy to this office positively on or before 21.2020 through email to inv-customs@gov. in . The hard copies should be forwarded only to DGRI/ DGGI, as applicable.
  9. The recommending/ forwarding officers must certify that they have checked the details about the achievements of the applicant officers with the documents/ records, before forwarding the proposal(s) with their recommendations/ comments to DGRI/ DGGI, as applicable. It should be ensured that no additional documents are enclosed, other than the duly-filled in Application in the prescribed Proforma and the word limit provided for each column/ item is duly maintained.

3. Further, all the  formations  while  forwarding/  recommending  an Application/ proposal shall ensure that:

  1. Vigilance History  of  the  Officer  to   be  enclosed-  All  matters  relating  to Vigilance   including  any  complaint/FIR/inquiry — past, present or contemplated —  relating  to  the  officers  for  whom  proposal  for  grant  of Presidential   Award   of   Appreciation   Certificates   &    Medals   is    being recommended/ forwarded are invariably brought to the notice of the Ministry while forwarding such Application/ Proposal.
  2. The proper authority/ Head of the Department, while recommending/ forwarding the Application/ Proposal should keep in mind the Instructions issued vide F.No.31/2/67/ADM-lll B, dated 8th May, 1969, for scrutinizing and recommending/ forwarding the cases of officers for consideration for the Awards, which have been summarised in the Annexure-1 to this letter.

4. This issues with the approval of the Member (Investigation), CBIC.

Instructions on forwarding applications/recommendations for Presidential Award of Appreciation Certificates Medals to be announced on the occasion of the Republic Day, 2021

1. The Award  for  Exceptionally  Meritorious  Service  at  Risk  of  Life  and  Specially Distinguished Record of Service is to be recommended on the basis of the following criteria (Based on Instructions issued vide F.No.31/2/67/ADM-III B, dated 8th May, 1969):-

A. Specific Guidelines for  recommending  Awards  for  Exceptionally  Meritorious Service at the Risk of Life:

  • Only those cases should be recommended for such Awards where the risk of life was grave and where the Officer knowing the risk involved in a particular act, still performed the meritorious act in question ;
  • The time at which and the circumstances in which an act at grave risk to life was performed should be indicated and it should be clearly explained whether such an act was done single-handedly or with the assistance of other Cases in which the risk was merely a possibility should not be made much of in all cases including those in which seizures are made on the high seas at great risk to life and the officers are considered to be deserving of the award, all the attendant circumstances should be clearly explained and the gravity of the situation faced by the officers should be clearly brought out;
  • Deserving cases of all officers (irrespective of their ranks) should be

B. Specific Guidelines for recommending awards for Specially Distinguished  Record of Service:

  • The cases of only those officers, who have consistently shown excellent performance during their day-to-day work and who have displayed exemplary devotion to duty, should be recommended for these Awards;
  • No officer, who possesses a consistently outstanding record of service, should be left out merely for the reasons that during his/ her service career, he/ she did not have the occasion to perform any spectacular or sensational seizure; or the cases of officers who have made a number of seizures, over a period of several years, should not be ignored just because the value of seizures made by them is small; or because each seizure, taken by itself, did not disclose any extraordinary talent;
  • Normally, only those officers who have put in a minimum of 15 years of service in the Department should be considered for such Award but in exceptional circumstances, the cases of the officers who have put in 10 years of service may also be recommended.

2. The word limits prescribed in the relevant columns shall be strictly adhered to.

3. the Proformas should be in A4 size paper and ‘Times New Roman’ Font, Size 11 should be used.

4. The authorities recommending/ forwarding the Applications/ Proposals should  ensure that the above instructions have been strictly adhered to in respect of the Applications/ Proposals being forwarded by their

Simplified Testing Procedure and ‘On-demand’ Testing for the first time

There has been an unprecedented upsurge in India’s daily testing capacities. For two successive days more than 11.70 lakh tests have been conducted per day. A total of 4 crore and 77 lakh tests have been done so far across the country. There are now 1647 testing laboratories operational which cover all States/UTs. It is in this background that the Health Ministry has issued the updated Testing Advisory. 
On recommendations of the National Task Force on COVID-19, the new Advisory has further simplified the testing process and given more freedom and flexibilities to the State authorities to facilitate enhanced ease of testing for the people.
For the first time, along with more simplified modalities, the updated Guidelines provide for ‘On-demand’ testing in order to ensure higher levels of testing.
The Advisory elaborates on the choice of tests (in order of priority) in various given settings.
  1. Routine surveillance in containment zones and screening at points of entry:
Choice of Test (in order of priority):
  1. Rapid Antigen Test (RAT) [as per attached algorithm]
  2. RT-PCR or TrueNat or CBNAAT
1. All symptomatic (ILI symptoms) cases including health care workers and frontline workers.
2. All asymptomatic direct and high-risk contacts (in family and workplace, elderly ≥ 65 years of age, immunocompromised, those with co-morbidities etc.) of a laboratory confirmed case to be tested once between day 5 and day 10 of coming into contact.
3. All asymptomatic high-risk individuals (elderly ≥ 65 years of age, those with co-morbidities etc.) in containment zones.

  1. Routine surveillance in non-containment areas:
Choice of Test (in order of priority):
  1. RT-PCR or TrueNat or CBNAAT
  2. Rapid Antigen Test (RAT)*
4. All symptomatic (ILI symptoms) individuals with history of international travel in the last 14 days.
5. All symptomatic (ILI symptoms) contacts of a laboratory confirmed case.
6. All symptomatic (ILI symptoms) health care workers / frontline workers involved in containment and mitigation activities.
7. All symptomatic ILI cases among returnees and migrants within 7 days of illness.
8. *All asymptomatic high-risk contacts(contacts in family and workplace, elderly ≥ 65 years of age, those with co-morbidities etc. [RAT is recommended as the first choice of test in order of priority]

  1. In Hospital Settings:
Choice of Test (in order of priority):
  1. RT-PCR or TrueNat or CBNAAT
  2. Rapid Antigen Test (RAT)
9. All patients of Severe Acute Respiratory Infection (SARI).
10. All symptomatic (ILI symptoms) patients presenting in a healthcare setting. 11. Asymptomatic high-risk patients who are hospitalized or seeking immediate hospitalization such as immunocompromised individuals, patients diagnosed with malignant disease, transplant patients, patients with chronic co-morbidities, elderly ≥ 65 years.
12. Asymptomatic patients undergoing surgical / non-surgical invasive procedures (not to be tested more than once a week during hospital stay).
13. All pregnant women in/near labor who are hospitalized for delivery.
Points to be noted:
·          
o

·         No emergency procedure (including deliveries) should be delayed for lack of test. However, sample can be sent for testing if indicated as above (1-13), simultaneously.
·         Pregnant women should not be referred for a lack of testing facility. All arrangements should be made to collect and transfer samples to testing facilities.
·         Mothers who test positive for COVID-19 should be advised to wear a mask and undertake frequent handwashing while handling their baby for 14 days. They should also be advised on breast cleaning before feeding the neonate. These measures are likely to reduce transmission of COVID-19 to their babies.

14. All symptomatic neonates presenting with acute respiratory / sepsis like illness. (Features suggestive of acute respiratory illness in a neonate are respiratory distress or apnea with or without cough, with or without fever. Neonates may also manifest with only non-respiratory symptoms like fever, lethargy, poor feeding, seizures or diarrhea).
15. Patients presenting with atypical manifestations [stroke, encephalitis, hemoptysis, pulmonary embolism, acute coronary symptoms, Guillain Barre syndrome, Multiple Organ Dysfunction Syndrome, progressive gastrointestinal symptoms, Kawasaki Disease (in pediatric age group)] based on the discretion of the treating physician.
A totally new section has been added in the Advisory on “Testing on Demand” which for all practical purposes does away with prescription by a registered medical practitioner although State governments have the freedom to decide on simplified modalities.
The new section reads thus-
  1. Testing on demand (State Governments to decide simplified modalities):
    1.  
      1. All individuals undertaking travel to countries/Indian states mandating a negative COVID-19 test at point of entry.
      2. All individuals who wish to get themselves tested.
Tracking and contact tracing mechanisms should be ensured by the testing laboratories by notifying the public health authorities.

Frequency of testing :
·         A single RT-PCR/TrueNat/CBNAAT/RAT positive test is to be considered confirmatory, without any repeat testing.
·         No re-testing is recommended prior to discharge from a COVID-19 facility after clinical recovery (please refer to MoHFW guidelines), including for transfer from a COVID area/ facility to a non-COVID area/ facility.
·         If symptoms develop following a negative RAT test, a repeat RAT or RT-PCR should be done (Algorithm for interpreting RAT is placed at Annexure 1).

Points to be noted:
·         WHO case definition for ILI: Individual presenting with acute respiratory infection with fever
≥ 38◦C AND cough with onset within the last 10 days.
·         WHO case definition for SARI: Individual presenting with acute respiratory infection with history of fever ≥ 38◦C AND cough with onset within the last 10 days AND requires hospitalization.
·         All healthcare workers and frontline workers coming in contact with suspect/confirmed COVID-19 patients should ensure use of appropriate PPE.
·         Home quarantine for 14 days is recommended for all individuals before undergoing elective surgery to minimise chances of infection before the procedure.

Sub: Promotional and Incentive Structure of PLI / RPLI – Clarification in respect of sales force – reg

This is regarding the promotional and incentive structure of PLI/RPLI, circulated vide PLI Directorate OM No. 28-03/2019-LI dated 19.06.2020 and implemented in Circles w.e.f. 01.07.2020.

2. In this connection, the following is clarified in respect of sales force procuring, PLI/RPLI business:

Order of preference in payment of incentive to sales force of PLI/RPLI.

Direct Agents are not Departmental Employees and majority of them are dependent on incentive for their livelihood. Therefore, there is a need to nurture and handhold Direct Agents by way of giving priority to them in incentive payment.

Accordingly, the following order of preference shall be followed by Circles while making payment of incentive to sales force of PLI/RPLI:
(i) Direct Agents
(ii) Gramin Dak Sevaks
(iii) Field Officers
(iv) Departmental Employees

(ii)

Nomination facility for sales force of PLI/RPLI.

(i) Nomination facility may be provided to sales force of PLI/RPLI. In the event of unfortunate death of a sales force, incentive will be paid to the nominee of that sales force for the PLI/RPLI business procured by that sales force for the period she/he was alive.

(ii) Further, if the nominee of the deceased sales force wants to procure PLI/RPLI business, she/he may apply for fresh direct agency licence. If found suitable, the concerned Division may issue fresh licence to her/him. Procurement/renewal incentive shall be paid only for the business procured by her/him subsequent to the issue of fresh licence.

(iii)Abolition of group agency system of  incentive

(i) Earlier, Group Leader was paid group incentive @ 7 % of the total procurement and renewal incentive payable to sales force under his jurisdiction. Resultantly, out of the total incentive on a PLI policy, the sales force used to get only 93% of the incentive and the remaining 7% used to be payable to the Group Leader.

(ii) In the new incentive structure, the group incentive structure has been abolished and done away with.

(iii) As a result, sales force of PLI and RPLI will get 100% of procurement and renewal incentive payable on PLI/RPLI policies as per prescribed rates effective from 01.07.2020.

(iv) In the new structure, Development Officer will be paid procurement incentive @ 1 % of total PLI/RPLI new business premium procured by Direct Agents attached to that Development Officer. The incentive payable to Development Officer will be over, and above the incentive payable to Direct Agents working under her/him.

(iv)Procurement of business by family members of Development Officer.

In order to avoid conflict of interest, members of family of business by family of Development Officer are not allowed to procure PLI/RPLI business and claim incentive. Members of the family for this purpose would include the following:

(a) The spouse, but not including a separated spouse or one living separately while judicial separation proceedings are on;

(b) Children and stepchildren but not including children and stepchildren of whose custody the serving postal employee has been deprived by law;

(c) Other persons such as wards and parents, who are dependent on and live with the Development Officer.

(v)Rate of incentive payable on PLI/RPLI policies.

Incentive payable on PLI/RPLI policies is being explained with the help of following illustration:

For a PLI policy procured on 1st November 2009, the procurement and renewal incentive payable on this policy is detailed as under:

(i) 01.11.2009 to 31.10,2010 (First Year Premium):
PLI Procurement Incentive during this period will be paid as per the procurement incentive rate applicable during that period.

(ii) 91.11.2010 to 30.06.2020:
Renewal Incentive during this period will be paid as per the renewal incentive rate applicable during that period.

(iii) 91.07.2020 onwards:
Renewal Incentive from 01.07.2020 onwards will be paid @ 1% of renewal premium.
