Cabinet approves Pan-India implementation of Maternity Benefit Program 
The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has given ex-post facto approval to Pan-India implementation of Maternity Benefit Program which now has been extended to all districts of the country w.e.f. 01.01.2017. The Prime Minister in his address to the nation on 31.12.2016 had announced Pan-India implementation of Maternity Benefit Program.

The Maternity Benefit Program will provide compensation for the wage loss in terms of cash incentives so that the women can take adequate rest before and after delivery and not be deprived of proper nutrition.
The total cost of the proposal for the period from 01.01.2017 to 31.03.2020 including Central and State Government share isRs.12,661crore. Government of India’s share during the period 01.01.2017 to 31.03.2020 comes to around Rs. 7932 crore.

Objective of the Scheme

i)        To provide partial compensation for the wage loss in terms of cash incentives so that the woman can take adequate rest before and after delivery of the first living child.

ii)      The cash incentives provided would lead to improved health seeking behaviour amongst the Pregnant Women and Lactating Mother (PW&LM) to reduce the effects of under-nutrition namely stunting, wasting and other related problems.

Target Group

All eligible Pregnant Women and Lactating Mothers (PW&LM), excluding the Pregnant Women and Lactating Mothers who are in regular employment with the Central Government or State Government or Public Sector Undertakings or those who are in receipt of similar benefits under any law for the time being. It has been decided to give the benefit of Rs.5000/- to PW&LM in three installment for the birth of the first live child by MWCD and the remaining cash incentive as per approved norms towards Maternity Benefit under existing programmes after institutional delivery so that on an average, a woman will get  6000/-.

Conditions and installments

Pregnant Women and Lactating Mothers who are eligible will receive a cash benefit of Rs.5,000/- in three installment at the following stages as specified in the table given below:

The eligible beneficiaries would continue to receive the remaining cash incentive as per approved norms towards Maternity Benefit under existing programmes after institutional delivery so that on an average, a woman will get  6000/-.

Mode of cash transfer to the Beneficiaries

The conditional cash transfer scheme would be in DBT mode.

Background:

The Government of India is committed to ensure that every woman gets adequate support and health care during pregnancy and at the time of delivery and every newborn is immunized on time which is the foundation for better health of the mother and the newborn. Normally, the first pregnancy of a woman exposes her to new kinds of challenges and stress factors. Hence, the scheme intends to provide support to the mother for safe delivery and immunization of her first living child. The improved health care seeking behaviour of the PW&LM would lead to better health status for the mother and the child.

Govt committed to right to privacy, WhatsApp should not 'leak' info, says SC


NEW DELHI: The Supreme Court today asked the government to ensure that 160 million Indian subscribers are not "entrapped" in any manner by service providers like WhatsApp, which is providing free services to its users. 

The government also told the apex court that it was in the process of evolving a regulatory regime on data protection which would be binding in nature. 

"State has a duty to protect the citizenry rights. Since service providers like WhatsApp and Facebook say we are giving it free, the state has to ensure that 160 million citizens who are using the service, are not entrapped in it," a five-judge Constitution Bench headed by Justice Dipak Misra said. 

The remarks by the top court came at the fag end of the day-long hearing after WhatsApp, while opposing the maintainability of the plea challenging its 2016 privacy policy, explained the nitty-gritty involved in it. 

The bench, which is hearing a challenge to the privacy policy of WhatsApp, also questioned whether the instant messaging platform can impose any condition on its users here which violated any part of the Constitution. 

While questioning the instant messaging platform why the world has "reacted" to its current privacy policy, the bench said nobody wants to share his or her data in "entirety". 

"The issue is that you (WhatsApp) have framed a policy inviting customers for the purpose of availing the service. In that sphere, can you impose any condition which violates any part of the Constitution," the bench asked WhatsApp, which was acquired by Facebook in 2014. 

"Why has the entire world, and a country like Germany, reacted to it? If it is such a laudable project, why are they reacting," the bench, also comprising Justices A K Sikri, Amitava Roy, A M Khanwilkar and M M Shantanagoudar, asked and observed, "we undertand the concept of charity". 

Senior advocate K K Venugopal, representing Facebook, told the bench that they were not sharing any sensitive or personal data and since India was shifting to digitisation, the service provided by WhatsApp was beneficial as it was end-to-end encrypted. 

"There are privacy laws in those countries. It is a matter which should be left to the government here," he said. 

Meanwhile, the Centre told the apex court, which would now hear the matter on July 21, that they were in the process of making a regulatory regime to deal with the issue. 

"At the outset, the central government is committed to freedom of choice and right to privacy of citizens. This is non-negotiable and we are committed to this," Additional Solicitor General (ASG) Tushar Mehta said, adding, "We are already in the process of doing it (regulatory regime)." 

"We are in the process of making either a statutory rule or executive guidelines, which would be binding in nature, on data protection," he told the bench. 

During the day-long hearing, Venugopal said there was no legal framework at present to deal with the issue but most of the prayers sought by the petitioners were covered under the 2011 rules of the Information Technology Act. 

"These rules have the framework, an issue which has been raised. My submission is that the petition is not maintainable," he said, adding that it was a matter of policy. 

He also said they were complying with the provisions of the rules which were in place in India. 

Senior advocate K V Vishwanathan, appearing for Internet Freedom Foundation (IFF), an intervenor in the case, said that though these rules would apply to WhatsApp and Facebook, but the entire issue, including the aspect of metadata, pending before the apex court, was not covered under it. 

"We find that the rules prescribe that there has to be a consent if you are sharing sensitive personal data. Suppose the consent is not taken effectively, what is the role of the constitutional court," the bench said and asked Venugopal,"

Subject:- Grant of Dearness Relief to CPF beneficiaries in receipt of ex-gratia payment-revised rated effect from 01.07.2016 and 01.01.2017-reg

In continuation of this Department’s OM No. 42/06/2016-P&PW(G) dated 03.05.2016 and OMs of even no. dated 16.11.2016 and 07.04.2017, the President is pleased to decide that the Dearness Relief @ 5th CPC w.e.f 01.07.2016 and 01.01.2017 to the following :

(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985, and are in receipt of ex-gratia @ Rs. 600/ p.m. w.c.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 & revised to Rs.3000, Rs.1000, Rs.750 & Rs.650 for Group A, B, C & D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&PW(E) dtd. 27th June, 2013 are entitled to 
Dearness Relief at the following rates :

(a)The widows and eligible children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and arc in receipt of Ex-gratia payment of Rs. 605/- p.m. & revised to Rs.645/-p.m w.c.f 04 June, 2013 vide OM No 1/10/2012-P&PW(E) dated 27th June,2013.

(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs. 654/-, Rs.659/-, Rs.703/- and Rs.965/-

3. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.

4. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.

5. In their application to the Indian Audit and Accounts Department, these orders issue after consultation with the C&AG.

6. This issues in pursuance of Ministry of Finance, Department of Expenditure vide their OM No. I/3/2008-E,II(B) dated 7th April, 2017.

सातवें वेतन आयोग के भत्तों के लागू होने का केंद्र सरकार के कर्मचारी और अधिकारी को आस है कि अब उनके अच्छे दिन शीघ्र आने वाले हैं. कार्मिकों के कुछ वर्ग को यह भी आस है कि सरकार यूनियन के मांग पर भी सकारात्मक रूख दिखा सकती है. जे.सी.एम. ने सरकार से मांग की है कि एच.आर.ए. के छठे वेतन आयोग के दर को कम नहीं किया जाए और सातवें वेतन आयोग में भी एच.आर.ए. के दर को एक्स, वाई और जेड श्रेणी के शहरों के लिए क्रमश: 30, 20 और 10 प्रतिशत ही रखा जाए. 

अपने इस मांग की वैधता के लिए जे.सी.एम. स्टाफ साईड ने एक विस्तृत मेमोरेण्डम सरकार को भेजा था जिसमें तथ्य और आंकड़े प्रस्तुत करते हुए कहा कि एच.आर.ए. का दर सातवें वेतन आयोग 24,16 और 8 प्रतिशत सिफारिश के अनुसार न रखा जाए. कर्मचारियों के सभी यूनियन इस मांग पर एकमत हैं कि सातवें वेतन आयोग में एच.आर.ए. के दर को एक्स, वाई और जेड श्रेणी के शहरों के लिए क्रमश: 30, 20 और 10 प्रतिशत ही रखा जाए. जे.सी.एम. स्टाफ साईड के एच.आर.ए. सबंधित मांग को स्टाफन्यूज पर पढ़ने के लिए क्लिक करें.

उपर दिये टेबल के अनुसार एक्स श्रेणी यानि मेट्रो शहरों के मल्टी टास्किंग स्टाफ को न्यूनतम रु. 5400 और अधिकतम रु. 17,070 प्रतिमाह मिलेगा वहीं पुराने ग्रेड पे 4200 अब वेतन मैट्रिक्स लेवल 5 के कर्मचारियों को न्यूनतम रु. 10,620 अधिकतम रु.33,720 तक की राशि मकान किराये भत्ते मिल सकेगा. एक ग्रुप ए अधिकारी सेवा में आने के समय एक्स श्रेणी की शहरों के लिए रु. 16,830, वाई श्रेणी की शहरों के लिए रु. 11,220 तथा जेड श्रेणी की शहरों के लिए रु.5,610 की राशि मकान किराए भत्ते के रूप में प्राप्त कर सकेगा.

अगर हम वर्तमान में होम लोन की किश्तों पर नजर डालें तो प्रति लाख रूपये के लिए करीब 1 हजार रूपये प्रतिमाह किश्त के रूप में अदा करना पड़ता है. यानि केन्द्र सरकार के कम वेतन श्रेणी में कार्यरत एक सामान्य कर्मचारी रु.10 लाख का ऋण अपने मकान के सपने को पूरा करने के लिए आसानी से ले सकेगा. सातवें वेतन आयोग के संशोधित एच.आर.ए. का इंतजार केन्द्र सरकार के सभी वर्ग के कर्मचारी कर रहे हैं. एच.आर.ए. में बढ़ोतरी उनके अच्छे आवास के किराये की अदायगी के लिए आवश्यक तो है ही साथ ही साथ नए ​मकान खरीदने या गृह ऋण की किश्त की अदायगी के लिए भी आवश्यक है. वर्तमान सरकार के योजनाओं की चर्चा करें तो सरकार के 'सबको आवास' योजना के लिए भी एच.आर.ए. में उचित बढ़ोतरी जरूरी है.

परंतु लाख टके का सवाल यह भी है कि सातवें वेतन आयोग की सिफारिश या यूनियन के मांग के अनुसार मकान किराये भत्ते को सरकार कब और किस तिथि से लागू करेगी? क्या सरकार कर्मचारियों के मांग के अनुसार 01.01.2016 से भत्तों पर एरियर देगी? इसके लिए परमन्यूज से जुड़े रहें अगले पोस्ट में सरकार की मंशा का विश्लेषण दिया जाएगा.
