Revision of Pension in RBI

175. SHRI THIRUMAAVALAVAN THOL:
Will the Minister of FINANCE be pleased to state:

(a) whether the approval sought for the revision of Pension to the retired employees of Reserve Bank of India (RBI) was rejected by the Government in the past;

(b) if so, the details thereof;

(c) whether revision of pension for the retired employees of RBI rejected by the Government is implemented by RBI; and

(d) if so, the details thereof and if not, the reasons therefor?

ANSWER

THE MINISTER OF STATE IN THE MINISTRY OF FINANCE (DR. BHAGWAT KARAD)

(a) to (d): Following a request made by the Reserve Bank of India (RBI) for revision of pension of its retired employees, the Central Government, on 5.3.2019, has approved an increase of 10% in pension plus dearness allowance. RBI has informed that it has implemented the revision vide its circular dated 7.3.2019.

(क) से (घ): : भारतीय रिजर्व बैंक (आरबीआई) के सेवानिवृत्त कर्मचारियों के पेंशन में संशोधन हेतु भारतीय रिज़र्व बैंक (आरबीआई) द्वार किए गए अनुरोध के पश्चात, केन्द्र सरकार ने दिनांक 5.3.2019 को पेंशन और महंगाई भत्ते में 10% की वृद्धि को मंजूरी दी है। आरबीआई ने सूचित किया है कि उसने दिनांक 7.3.2019 के उसके परिपत्र के माध्यम से उक्त संशोधन को लागू कर दिया है।

 Biometric-Enabled Digital Service for Pensioners: Digital Life Certificate – Jeevan Pramaan

Digital Life Certificate for Pensioners Scheme, known as Jeevan Pramaan, digitises the entire process of securing life certificate, making it hassle-free for pensioners.

Making lives of senior citizens easy has been the priority of the Government. More than one Crore families in India can be classified as pensioner families, where the pension disbursed by the various Government bodies is the main source of income. However, pensioners have to provide life certificate every year to the authorised pension disbursing agencies like banks, post offices etc., following which their pension is credited to their respective accounts.

In order to get life certificate, the pensioners are required to either personally present themselves before the Pension Disbursing Agency or have the Life Certificate issued by authority where they have served earlier, and have it delivered to the disbursing agency.

This very requirement of appearing personally at the disbursing agency office for getting a life certificate often becomes a major hurdle in the process of seamless transfer of pension amount. It has been noted that it causes a lot of hardship and inconvenience particularly to the aged and infirm pensioners.

Additionally, many employees move to a different location after their retirement either to be with their family or for some other reasons. This creates a huge logistical issue when it comes to accessing their rightful pension. Jeevan Pramaan was launched to make lives of senior citizens easy. It is a biometric- enabled digital service for pensioners of Central Government, State Government or any other Government organization.

ABOUT JEEVAN PRAMAAN

The Ministry of Electronics and information Technology has launched the Jeevan Pramaan portal as a Digital India initiative to mitigate the hardships of pensioners. Now, the pensioner need Not visit the office of the disbursing agency for physical submission of life certificate and may use the Aadhaar- enabled biometric authentication mechanism to generate Digital Life Certificate (DLC). It was launched by Prime Minister Narendra Modi on November 10, 2014. Since then, 358.55 Lakh pensioners have submitted the Digital Life Certificates. Between November 1, 2019 and October 12, 2020, a total of 95.31 Lakh pensioners have submitted the DLC.

ADVANTAGES OF DIGITAL LIFE CERTIFICATE

  • It can be generated from anywhere, including home
  • Auto SMS to pensionersregarding DLC
  • Auto transfer of DLC to Pension Disbursing Agency
  • Sending SMS by Pension Disbursing Agency after Processing

PENSION DISBURSING AGENCIES

Pension Disbursing Agency means the Life Certificate processing agency for the pensioner. Following Disbursing Agencies may be eligible for on-boarding:

  1. Banks
  2. Post Offices
  3. State/UTs Government Offices (Treasuries)
  4. Central Government Offices
  5. Autonomous bodies /statutory organizations / societies / PSUs of Central Government
  6. Autonomous bodies / PSUs of State Government
  7. Bodies created through Parliament / State Legislation
  8. Judicial Organizations

PRE-REQUISITES FOR DLC GENERATION

  1. Pensioner must have an Aadhaar number
  2. Pensioner must have a working mobile number
  3. Registration of Aadhaar number with Pension Disbursing Agency
  4. A Biometric device
  5. PC with Windows 7.0 and above or Android Mobile/Tablet 4.0 and above
  6. Internet connectivity

DLC FOR PENSIONERS SETTLED ABROAD

For the senior citizens who have settled abroad after retirement, the Government has issued Consolidated Instructions on Life Certificate and commencement of Family Pension vide which the concerned Bank Branch abroad and the Indian Embassy/ Consulate/High Commission have been instructed to provide Life Certificate and commencement of Family Pension there itself.

ALSO ON UMANG APP

To ensure safe and secure door-step delivery of its services to its 66 Lakh pensioners, EPFO brought the facility of View Pensioner Passbook as well as the updation of Jeevan Pramaan Patra on UMANG App. During the COVID-19 pandemic period from April to July 2020, 18.52 Lakh API hits were received to View Pensioner Passbook service while 29,773 API hits were recorded on updating Jeevan Pramaan Patra service.

ADDITIONAL TIME GIVEN THIS YEAR

Amid the ongoing COVID-19 pandemic, pensioners can submit life certificates between November 1 and December 31. Earlier, life certificates used to be submitted only in November for maintaining continuity of pension.

Exeract of jadgement- para 16 to 19(5) & 20

16. Before parting with this Judgment, we need to remind the Bank that the pension payable to the employees upon superannuation is.a ‘property’ under Article 300-A of the Constitution of India and it constitutes a fundamental right to livelihood under Article 21 of the Constitution of India. The deprivation, even a part of this amount,cannot be accepted, except in accordance with and authority of law. Article 41 of the Constitution of India in the Part IV of Directive Principles of Stale Policy has created an obligation upon the State to recognize a right of public assistance in the case of old age. sickness and disablement. Article 46 therein requires the State to promote with special care the economic interests of the weaker sections of the people In short, the foresaid provisions of the directive principles of State policy create an obligation upon the State to enact suitable laws, making the provisions to recognize a right of public assistance to Promote economic interests, to protect the life and property of senior citizens, to treat them with respect and dignity and to give wide publicity to it.

17. Unfortunately. the time has come to tell the Bank that the aging is natural process, which leads to weakening of the body and mind. The productivity, working ability and mobility decreases or paralyzes with growing age. The traditional norms, values and culture in the Indian Society demand to treat the senior citizens with respect, dignity and lay stress on providing security, care and assistance to them. It becomes a part of the human right of the senior citizens. The senior citizens are the persons who had shouldered the responsibility of building a nation in general and society of community in particular, while in service. Utilizing their experience in the life and working, the strong shoulders are created of young persons to substitute and rest the responsibility upon them, while demitting the office. The bank officials must realize that tomorrow it may be their turn, upon superannuation, to fight for the pension or post-retiral benefits. The thought process, therefore, to be adopted should be of a person in a situation like the petitioner. ‘The respect, dignity, care, sensitivity, assistance and security would automatically follow.

18. We have, however, seen and can take judicial note of the fact that the security of the senior citizens always remain in peril. We have seen the senior citizens anxiously waiting for credit of the Pension amount in their account and standing in a queue for withdrawal. Once the amount is withdrawn personally either from the Bank or from the ATM, a serious threat starts posing to the life from the watchdogs roaming around involved in pick-pocketing and stealing. We have actually seen the old aged persons-men and women, counting the currency with cramping hands and trying to secure the amount at some hidden place in the body. It is seen then after waiting in the premises of the Bank and taking stock of the situation and the atmosphere with scared mind and the feeling of insecurity, the escape route and time is chosen to reach to their destination safely. It is a high time for the Banks to create a separate cell and to device a method to provide personal service through the men of confidence, at the door-step to the old aged, disabled and sick persons who are the senior citizens. They have to be treated with respect and dignity. The sensitivity to the problems of the senior citizens need to be addressed. The mechanism for immediate redressal of grievance needs to be provided. The officers having a degree or master’s degree in Social Work or Psychology, who can be in personal touch with and genuinely understand and redress the grievances or complaints of the senior citizens, can be appointed.

19. In the result, this petition is allowed and the following order is passed : (1) The action of the respondent No. 3- Bank in deducting an amount of Rs.11,040/- per month with effect from October, 2019 is hereby quashed and set aside. (2) We direct the respondent No 3- Bank to immediately credit an amount of Rs. 3,27,045/-, recovered from the pension account of the petitioner, along with interest at the rate of 18% per annum from the date of recovery of each of the installments, till the date of credit of this amount in the pension account of the petitioner.

(3) The respondent No. 3- Bank is restrained from recovering any amount from the pension payable to the petitioner on the basis of the action, which we have quashed and set aside.

(4) We direct the respondent No 3- Bank to pay the compensation of Rs 50,000/- to the petitioner and credit the said amount in the pension account of the petitioner within a period of eight days from today, failing which the additional costs of Rs.1,000/- for each day’s delay will have to be paid.

(5) We direct the Registry of this Court to forward the copies of this Judgment to the Centralized Processing Pension Centres of all the Nationalized Banks and also to the Reserve Bank of India and the Chief Secretary, Government of Maharashtra, to consider the question of constitution of separate cell and release of appropriate guidelines so as to attain the constitutional goal of providing respect, dignity, care, sensitivity, assistance and security to all the pension account holders in the Banks.

(6) This Judgment be uploaded under the digital signature of the Private Secretary.

20. Rule is made absolute in the aforesaid terms. No order as to further costs.

The article that was published yesterday seeks to answer critics who claim that the new pension scheme is outright bad. The undersigned is directed to refer to this Department's OM of even no. dated 12.08.2015 and to say that the instructions related to the issue of Pensioners' Identity Card to Pensioners were issued by this Department. In para 2 of the OM dated 12.08.2015, it is mentioned that Pensioners' ID Card shall include the Aadhaar No. of the pensioners, if available. Accordingly, a format for the pensioners' Identity Card was also issued.

2. The matter has been reconsidered. It has been decided that henceforth, the Pensioners' Identity Card may be issued to the pensioners in the revised format (copy enclosed).
